Case Summary:

Nearly a year after North America Immigration Law Group (NAILG) filed an EB-2 NIW (National Interest Waiver) petition for a doctoral candidate from Iran, the USCIS approved his case. After months of hard work, we filed an NIW petition that highlighted our client’s various achievements such as the 2 journal articles, 3 book chapters and 1 conference article in his name. We also touched on the 137 times his work was cited. Further, we gathered information related to his research on mechanism design and pricing mechanisms demonstrated that his findings contribute to growing social network product markets in the US.

Filing an I-485, I-765 and I-131:

Our client also retained our firm to help him file I-485 applications for himself and his spouse. This is the second and final step in the green card process, which our client chose to undertake while his NIW petition was still pending approval. Along with the I-485 application, our client and his spouse also applied for an I-765 (application for EAD) and I-131 (application for AP) each.

Although our client has a valid non-immigrant visa status, a pending I-485 and an EAD allows him to legally remain in the United States and be employed should he lose his non-immigrant visa status. Unfortunately, because our client’s non-immigrant visa strictly requires nonimmigrant intent, he cannot travel on this visa. Thanks to the AP however, our client and his spouse can leave and re-enter the US, which allows them to visit their families after several years of separation.
