On March 24th, 2023 and September 27th, 2023, we received another O1-A (Individuals with Extraordinary Ability or Achievement) and EB-2 NIW (National Interest Waiver) approval for a Research Scientist in the Field of Machine Learning (Approval Notice).

General Field: Machine Learning

Position at the Time of Case Filing: Research Scientist

Country of Origin: China

State of Residence at the Time of Filing: California

Approval Notice Date: March 24th, 2023 (O1-A) and September 27th, 2023 (NIW)

Processing Time: 1 month, 16 days (O1-A) (Premium Processing Requested) and 3 months, 1 day (NIW)

Case Summary:

While the O1A visa benefits aliens of extraordinary ability in the sciences, arts, education, business, or athletics, those foreign nationals should at least have:

  • Sustained national/international claim;
  • Their achievement must be recognized in the field through extensive documentation;
  • Current/previous employment in a critical or essential capacity for organizations or establishments with a distinguished reputation.

The NIW petitioners on the other hand must fulfill the below-mentioned prerequisites:

  • The foreign national must be in a position to advance the proposed endeavor;
  • The applicant must present evidence that the U.S. would benefit on balance to waive the job offer criteria for an EB-2;
  • A proposed endeavor, holding substantial merit and national importance.

After completing his B.Sc. in computer science, our client, a research scientist from China, approached us to file his NIW (National Interest Waiver) and O1A (Individuals with Extraordinary Ability or Achievement) petitions on his behalf.

His research addresses some of our nation’s most pressing issues including the susceptibility of deep neural networks to adversarial attacks, along with the substantial energy consumption of AI systems. To wit, his work has been funded by prestigious government agencies and non-governmental organizations, including the National Science Foundation (NSF) and its Divisions of Information and Intelligent Systems (IIS), Computer and Network Systems (CNS), and Computing and Communication Foundations (CCF), the Office of Naval Research (ONR) and its Multidisciplinary University Research Initiative (MURI), the National Institutes of Health (NIH), and the Amazon Research Awards.

Consequently, to make a strong case in his favor, we included the following details in his petition packet:

  • His work has resulted in 1 peer-reviewed journal article, 9 peer-reviewed conference papers (3 of them co-first-authored and 2 of them first-authored), and 5 granted patents.
  • His publications have been cited at least 746 times according to Google Scholar.
  • He has completed at least 18 peer reviews.

He has even received 5 recommendation letters from his fellow experts in the field, one of whom remarked:

“The testimony I have provided in this letter, delineating [client’s] professional and academic credentials, citation total, and distinguished machine learning research, illustrates that [client’s] specialized knowledge and skillset are of significant value to the United States as well as the field of machine learning.”

Eventually, he received his O1A visa approval despite a request for evidence [RFE]. He even acquired his NIW approval without waiting for very long. We are glad to be a part of his successful journey and wish him a flourishing life ahead.
