Case Summary:
A Ph.D. candidate from Taiwan chose North America Immigration Law Group (WeGreened.com) to help him get a green card. After carefully evaluating his credentials, we determined that he qualified for EB-2 NIW (National Interest Waiver). Upon execution of the contract, we immediately got to work putting together a strong case for our client.
Our Strategy:
One of the first things that we did was to encourage our client to obtain recommendation letters from experts in his field of cancer biology. Four experts agreed to lend their support, all of whom attested to the fact that our client’s work is of significant value to the United States and that his presence in the country is an asset to the nation. For instance, one of these letters stated that “The country in which [Client] resides and the institutions where he works and studies will gain a tremendous advantage in having him in such proximity. … Those within the scientific community are cognizant of all that [Client] has done and it is crucial to our country’s viability in the worldwide pharmaceutical market that he be allowed to continue his career in the United States.”
We also described our client’s research efforts on the progression and mechanisms that drive cancer growth, and established that his substitution with another researcher with similar credentials would adversely affect the country’s national interest. Our EB-2 NIW petition was also composed of our client’s publication and citation record, which at the time of filing stood at 17 and 134 respectively.
Final Decision:
It took Texas Service Center considerably longer than the norm to adjudicate this case (they spent over 10 months reviewing this petition whereas the average timeframe stands at between 4-9 months). Despite the long wait, we are pleased that they ultimately granted their approval. We would like to congratulate our client on this milestone and we wish him well as he completes the final leg of the green card journey: the I-485 application.
