Case Summary:

Last year, a research assistant from Taiwan hired North America Immigration Law Group (WeGreened.com) to file an EB-2 NIW (National Interest Waiver) petition on his behalf. Our client, who has extensive experience in the field of materials engineering, hired us because he knew that we would do everything we could to help him get one step closer to his green card. In preparing our client’s EB-2 NIW petition, we made sure that we had all the relevant paperwork that proved the value of his investigations to the United States. Here are some of the points that we highlighted in our presentation:

  • Our client’s investigations on nanotechnology and biosensors is of great importance because it is contributing to the more efficient, cost-effective, and rapid detection of a variety of pathogens and contaminants in blood and food.
  • Our client reached out to several of his peers and asked them to sign recommendation letters. The five letters that he obtained were included in his EB-2 NIW petition packet and presented to the USCIS as evidence that he is an asset to the United States. According to one of our client’s recommenders (a prominent professor): “His developments on identifying these microorganisms are thus of value to the millions of people who contract viral and bacterial infections annually. It should further be noted that [client’s] developments are of intrinsic merit owing to their simplicity and efficacy compared to other methods. The significance of his achievement to both his research community and the wider medical field are thus clearly evident.”
  • We noted his 8 peer-reviewed journal articles (3 of them first-authored) and 2 peer-reviewed conference papers that had gathered nearly 43 citations at the time of filing. Using these numbers, we established that various researchers around the world are utilizing our client’s findings to progress the field of materials engineering as a whole.

Overall, it was 6 months and 8 days before the USCIS approved our client’s EB-2 NIW case, and we are pleased that they ultimately granted approval. The final step in the green card process is filing an I-485 application. We helped our client file two applications, one for him and one for his spouse. We join them as they await good news from the USCIS. In the meantime, we wish our client the best as he continues to contribute to the United States’ broader health care system by developing more affordable and efficient methods for identifying the O157:H7 strain of E. coli, a foodborne pathogen that causes serious disease.
