Client’s Testimonial:
“Thank you! This is great news!”
On March 1st, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Fellow in the Field of Medical Genetics (Approval Notice).
General Field: Medical Genetics
Position at the Time of Case Filing: Postdoctoral Fellow
Country of Origin: Taiwan
Service Center: Nebraska Service Center (NSC)
State of Residence at the Time of Filing: Texas
Approval Notice Date: March 1st, 2016
Processing Time: 7 months, 28 days
Case Summary:
This story of success involves a postdoctoral fellow from Taiwan. He hired North America Immigration Law Group (WeGreened.com) to help him obtain a green card, which we did efficiently. There are two steps to getting a green card: the I-140 petition and the I-485 application. Based on our client’s credentials, he qualified to file his I-140 petition under the EB-2 NIW (National Interest Waiver) visa category. The USCIS spent a little under eight months reviewing his petition before granting their approval. Because our client elected to file his I-485 application while his I-140 petition was pending approval, he significantly reduced the wait time and received both approval notices less than a month apart.
Legal Strategy:
We were tasked with putting together a strong EB-2 NIW petition packet to convince the USCIS that our client deserved to have his I-140 approved. One of the first things that we did was to advise our client to contact other experts in his field of medical genetics for recommendation letters. These letters served as evidence that our client’s professional accomplishments are legitimate and that his work is of great value to other researchers in the field. One of our client’s recommenders had this to say about his findings: “I could not be more impressed with [Client] for mastering the two disparate forms of genetic analysis discussed above. Experience in both is rare among genetic researchers, which speaks to the uniqueness of [Client’s] skill set. Add that to his hands-on experience in urology and nephrology, and it is clear that [Client] is a truly irreplaceable talent. I look forward to many more years of outstanding research from him.”
Besides recommendation letters, our carefully worded NIW petition dossier was comprised of data on our client’s 13 journal articles and the 126 citations they had gathered at the time of filing. Furthermore, we detailed our client’s investigations on candidate genes and genome-wide analyses for genetic diseases, as well as studies in urology and nephrology. We convinced the USCIS that our client’s work lends a hand in elucidating the genetic causes of diseases that are affecting public health in the United States, and that his research significantly impacts the country’s medical system.
Story of Success:
Overall, we raised one service request on our client’s behalf when the processing time went beyond the average stretch. Besides that, we experienced no speedbumps along the way and we congratulate our client for obtaining his green card. We thank him for selecting our firm to represent his case and we wish him all the best with his continued research endeavors.
