Case Summary:

Exactly 1 year after we filed an EB-2 NIW (National Interest Waiver) petition on behalf of an adjunct assistant professor from Bangladesh, the USCIS approved his case. At first glance, our client was suitably qualified for the national interest waiver as amongst other things, he possessed a Ph.D. in statistics as well as many years of experience researching the same field.

Assembling a Strong NIW Petition:

Part of the process in getting our client closer to his green card involved presenting his various achievements to the USCIS. These were several of the points we focused on:

  • We noted our client’s significant citation record: at the time of filing, he already had 56 citations to his published research. Moreover, he had 10 peer-reviewed journal articles (7 of them first-authored) and 4 peer-reviewed and first-authored conference articles, which we highlighted in the petition. We also noted the 5 times our client judged the work of his peers.
  • Our client’s work is concentrated specifically on improved statistical models and estimation techniques for extreme meteorological events. His research in this area is of great importance because it supports improved modeling of weather systems. Statistical modeling is an important tool used by meteorological researchers to understand and predict complex weather systems, enabling them to track dangerous weather events days and even weeks in advance. In a nutshell, we clearly demonstrated to the USCIS that our client’s findings have a profound impact in the field of statistics.
  • Of additional significance were the 5 recommendation letters that were signed by our client’s peers, all of which were included in our client’s well planned NIW dossier. One of these letters stated: “As a result, [client’s] research on interpreting events of extreme heat is of great benefit to the United States. [Client’s] novel findings allow for better interpretation of critical weather data that is disseminated to millions of people across the country, helping to mitigate the effects of extreme weather in the United States.”

Despite our meticulous presentation of our client’s strong credentials, the USCIS issued a Request for Evidence (RFE). As soon as we received the RFE, our legal team sprang into action. We promptly responded to the RFE and successfully dealt with all hesitations about our client’s qualifications. Overall, it was 11 months and 28 days before the USCIS approved our client’s EB-2 NIW case, and we are pleased that they ultimately granted approval.
