Case Summary:

With a Ph.D. in Mechanical Engineering and extensive experience conducting impactful research, our client—a postdoctoral research associate from Iran—seemed like a good candidate for EB-2 NIW (National Interest Waiver). Before taking on his case, we went through his credentials to be sure that we could build a solid petition for him. Only once we confirmed it did we countersign the retainer agreement.

So what did our client’s NIW petition packet contain? For one, it was filled with information pertaining to our client’s work in the field of mechanical engineering. Thanks to his comprehensive research summary, we were able to determine that his efforts are focused on process engineering and characterization of reinforced composite materials, including nanoclay particle reinforced polymers and carbon nanotube reinforced epoxy resins, continuous fiber reinforced composites, and the characterization and optimization of the bio-based constituents of marine seashells. We then concluded that our client’s research is important to the U.S. aerospace transportation, packaging, and chemical materials manufacturing industries, with direct benefits for the environment and ultimately for public health.

Besides research information, the NIW packet also contained four recommendation letters. Contributed by other experts in the field, these letters highlighted the significance of our client’s 16 publications and the 113 citations they had gathered. The letters also advocated for the approval of our client’s NIW petition. As an example, this is what one of our client’s recommenders noted: “… [Client]  is a vital researcher in mechanical engineering and his continued direct contributions to the United States scientific community should continue.”

Overall, the USCIS spent 10.5 months processing our client’s NIW before approving it. Despite the relatively long wait (the norm is between 4-9 months), we are pleased that he secured the national interest waiver. We are currently waiting for the USCIS to take action on our client’s I-485 application (final step in the green card process). Once approved, he will become a US permanent resident. Meanwhile, we wish him the best as he continues to progress the field of mechanical engineering here in the US.
