Just 98 days after we filed an EB-2 NIW (National Interest Waiver) petition on behalf of a postdoctoral research fellow from the Philippines, Texas Service Center approved her case. There are two steps involved in the lengthy green card process: filing an I-140 petition and an I-485 application. In this case, our client chose to file her I-485 application while her I-140 EB-2 NIW petition was pending approval. Green card applicants can choose to either file them simultaneously, file the I-485 application after the I-140 petition is approved, or do what our client did. She is now waiting for favorable news from the USCIS and we wish her well as she continues to progress the field of microbiology.
