Approval Notice Date: April 27th, 2017

Case Summary:

North America Immigration Law Group (NAILG) recently received an approval notice for an EB-2 NIW (National Interest Waiver) petition that we filed on behalf of a postdoctoral fellow from Mexico. The USCIS spent 5 months adjudicating the case before granting their approval (based on Matter of Dhanasar*).

One of the first steps we took was to analyze our client’s credentials, and once we concluded that we could help him obtain the national interest waiver, we established an attorney-client relationship and included the following information in his NIW petition packet:

  • A detailed account of his research that focuses on developing enhanced oil recovery (EOR) methods, and solving problems related to flow assurance and preventing oil reservoir damage.
  • We noted his 8 peer-reviewed journal articles and 6 conference papers that showcased his consistent contributions to the field. The fact that these publications had been cited a total of 44 times at the time of filing proved that his work is of immense value to other researchers in the field. In addition to that, he had also conducted at least 12 peer reviews for several renowned journals.
  • Most importantly, we included several recommendation letters that testified to his credentials and reiterated our arguments that our client’s work greatly benefits the United States. A recommender wrote: “This field consequently requires a comprehensive, multidisciplinary approach that brings together knowledge and methodology from a wide range of related disciplines. For this reason, very few individuals are capable of obtaining a sufficient background in this field, and even fewer are able to reach the level of success attained by [Client].

We are extremely pleased that our client secured NIW petition approval, and we congratulate him on this win. We recently filed an I-485 application on behalf of him and his dependent, and we join them as they await good news from the USCIS. Once approved, their status as US permanent residents will be finalized.

*Matter of Dhanasar (issued on December 27, 2016) is the new analytical framework to assess eligibility for NIW, replacing the old three-prong test set by the overturned precedent NYSDOT. To find out more, please head to http://www.wegreened.com/niw/
