On July 3rd, 2017, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Fellow in the Field of Bioengineering (Approval Notice).

Case Summary:
Last year, a postdoctoral fellow from Vietnam approached North America Immigration Law Group (NAILG) to file an EB-2 NIW (National Interest Waiver) petition on his behalf. Seeing that his petition was approved after December 27th, 2016, his case was adjudicated based on the new AAO decision (Matter of Dhanasar)*. Despite the change (which took place 7 months after his case was filed), we had built a solid case for our client and were confident that the USCIS would grant him petition approval based on the new framework.
What did the NIW petition contain?
We made sure to detail our client’s various achievements in the field of bioengineering. We one, we noted that our client’s research addresses some of the United States’ most pressing medical and technological needs. We demonstrated that our client’s work is important, particularly in developing new materials for a variety of medical applications, such as improving wound healing and cancer treatment. We also noted that his research has resulted in 3 refereed conference papers and abstracts, 3 patents, and most importantly, 10 full-length, peer-reviewed journal articles which had been cited a total of 97 times at the time of filing.
Advocating for this outstanding record of achievements were a number of recommendation letters from notable scientists who have either worked with our client and/or referenced his work. They provided some very helpful information (as evidenced by the statements below) which supported our argument that our client’s work is in the interest of the nation.

We raised a service request on our client’s behalf after his case went over the normal processing timeline and we received notification of case approval not long after. Overall, our client waited over a year to be granted NIW approval. We congratulate him for obtaining the national interest waiver, and we thank him for retaining us for the I-485 application (last step in the green card process).
