Case Summary:
With a Ph.D. in mechanical engineering and many years of experience working in the field of data science, our client decided that the time had come for him to secure a green card. He approached North America Immigration Law Group (NAILG) for help with the first step of the green card process: filing an I-140 petition. After evaluating his credentials, we determined that he would be a suitable candidate for EB-2 NIW (National Interest Waiver). These are some of the key points included in his petition:
- We noted the 5 peer-reviewed journal articles (1 of them first-authored) and 6 peer-reviewed conference articles (3 of them first-authored) to his name, all of which were published in well-known scientific journals. The dissemination of our client’s work via journals ensured that various researchers around the world had access to his findings, and thus, are able to work collectively to progress the field as a whole.
- Thanks to Google Scholar and other reliable sources such as Scopus, we determined that our client’s work had been cited 98 times at the time of filing. This proved to the USCIS that his findings impact the work of other researchers.
- To back up our argument that our client deserved the national interest waiver, we included recommendation letters volunteered by four other experts in the field. According to one of them: “[Client’s] research indicates methods of increasing the life expectancy of microinverters through careful calibration with PV module power handling. [Client’s] innovations expedite solar experimentation, reducing costs and making solar energy in the U.S. more affordable and efficient.”
As we were able to prove to the USCIS that our client’s investigations on the development of data collection, analysis, and machine learning methods to facilitate effective decision making in real-world situations is important to the US because this research is supplementing the resources available to lessen the emission of greenhouse gases. Although we presented a strong case to the USCIS, our client’s petition was issued a Request For Evidence (RFE). With our experience of securing over 16,000 I-140 approvals, we put together a solid response which eventually led to the case approval after 9 months and 14 days. We congratulate our client for surpassing this milestone. We recently sent him our complimentary D.I.Y packet to help him with the I-485, and we wish him the best with the final step in the green card process.
