Client’s Testimonial:
“Thank you very much for your endurance and effort in preparing my case and making it get approved.”
On September 29th, 2021, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Researcher in the Field of Geotechnical Engineering (Approval Notice).
General Field: Geotechnical Engineering
Position at the Time of Case Filing: Postdoctoral Researcher
Country of Origin: Vietnam
State of Residence at the Time of Filing: West Virginia
Approval Notice Date: September 29th, 2021
Processing Time: 10 months, 25 days
Case Summary:
Based on the huge number of successful cases, North America Immigration Law Group has developed the most up-to-date winning strategies for the NIW category, which enable us to offer our “Approval or Refund” services to many of the NIW cases we take. However, there are certain pre-conditions to be fulfilled by an individual including:
- The foreign national must be in a position to advance the proposed endeavor.
- The applicant must present evidence that the U.S. would benefit on balance to waive the job offer criteria for an EB-2.
- A proposed endeavor, holding substantial merit and national importance.
Therefore, through our prowess and based on the above requirements, we prepared a persuasive case for our client who after completing his Ph.D. in geotechnical engineering, is currently employed as a postdoctoral researcher in the field of geotechnical engineering. We highlighted the following key elements in his petition packet:
- His work has resulted in 7 peer-reviewed journal articles (4 of them first-authored), 3 peer-reviewed conference articles, and 3 technical reports, cited a total of 42 times according to Google Scholar.
- He has completed at least 7 peer reviews to date.
- His research has been supported with funding from the Federal Highway Administration and the Colorado Department of Transportation which is reserved solely for research directed at advancing the national interest.
- He has received 5 recommendation letters from his fellow experts in the field, one of whom remarked:
“…[Client’s] work is inherently valuable to the United States…[Client’s] work is yielding such capabilities and has further offered novel insights as to how the cost of bridge construction and replacement can be reduced…Only geotechnical engineers of [client’s] caliber possess the skills to continue making such valuable advancements. Consequently, retaining his talents constitutes a national imperative.”
Consequently, our client’s proposed endeavor is to continue his research on developing computer codes and performing full-scale experiments for the non-destructive testing of pile foundations and concrete structures to improve transportation infrastructure health monitoring and thus is relevant to determining the structural and foundational health of bridges.
Therefore, he got a conclusive response from the adjudicating judge and received his NIW approval without any further request for evidence [RFE]. We are pleased to be a part of his journey and congratulate him for showing his patience throughout the process. We wish him the very best in his life.
