As we are aware the National Interest Waiver (NIW) is an exemption from the job offer and labor certification requirements if the exemption would be in the national interest. To receive approval of a National Interest Waiver, three factors must be shown to USCIS: (1) whether the individual seeks to work in an area of substantial intrinsic merit; (2) whether the benefit of the alien’s proposed activity will be national in scope; and (3) whether the alien will serve the national interest to a substantially greater degree than would an available U.S. worker having the same minimum qualifications. Thus, our petitioned NIW application for our client was so solid that his NIW case was approved by the USCIS adjudication authorities in just 6 days, with no request for further evidence (RFE) issued.
