Success Stories: Graduate Research Assistant in the Field of Chemistry Received NIW Approval Despite RFE

Client’s Testimonial:

“Thank you very much for your hard work.”

On December 3rd, 2019, we received another EB-2 NIW (National Interest Waiver) approval for a Graduate Research Assistant in the Field of Chemistry (Approval Notice).

General Field: Chemistry

Position at the Time of Case Filing: Graduate Research Assistant

Country of Origin: Iran

State of Residence at the Time of Filing: California

Approval Notice Date: December 3rd, 2019

Processing Time: 9 months, 29 days

Case Summary:

Filing an I-140 (Immigrant Petition for Alien Workers) is the first step for an alien worker to become a permanent resident in the United States. Our client reached out to North America Immigration Law Group (WeGreened.com) with our free evaluation service to see if she was a good fit for an EB-2 (National Interest Waiver) petition. We carefully went through her CV and credentials and determined that she should have a viable NIW case to pursue.

As an expert in the field of Chemistry, our client’s research focuses on creating green synthesis methods so that chemical compounds are able to be created without the use of toxic chemicals. This is an especially pressing concern for chemical compounds used to treat illnesses and other medical conditions, which is of great importance in her area because it directly aids in the development of novel disease treatments.

Apart from completing successful research in the field, our client has also published 6 peer-reviewed journal articles (2 of them first-authored) that collected 31 citations by the time when we were ready to file her case. The fact that her papers being published in the top journals and that her peers leveraged her research demonstrated that our client’s work is widely recognized and relied upon in the field of chemistry.

Six of her peers were also willing to contribute letters of recommendation to support her petition. These letters were incorporated into the petition packet as proof of her important standing in the field in order to further strengthen the petition. The following statement was what one of the recommenders had to say about our client’s research: “[Client]’s work holds significance to the country because of its relation to the development of pharmaceuticals, since this development is important for improving healthcare in the United States…Each of these pursuits are useful for progress in chemistry as well as general biomedical advancement. With her research, [client] has secured herself an esteemed position among her peers in the field.”

Although we presented a strong case to the USCIS, our client’s petition was issued a Request of Evidence (RFE). We utilized our experience of securing over 15,000 I-140 approvals and put together a solid response which eventually led to the case approval after 10 months of waiting. We are pleased to see our hard work paid off, and we thank our client for also choosing us to help her adjust her status in the United States (i.e. file an I-485).
