Case Summary:

With a bachelor’s degree in materials technology and many years of experience conducting impactful biomedical engineering research, this graduate research assistant from Vietnam was a good fit for EB-2 NIW (National Interest Waiver). After evaluating his extensive credentials, we determined that we could help him secure the national interest waiver. One of the first things we did was to help our client select a handful of recommenders. In our experience, recommendation letters are very important in paving the way to I-140 case approval, and we wanted our client’s petition packet to contain strong letters of support from other prominent researchers. Not long after we narrowed down the list of potential recommenders, our client returned with six signed letters, all of which advocated for the importance of his work to the United States and the field as a whole. According to one of these letters: “Thus, the ability to identify lead in drinking water is a necessity for maintaining the health of populations. By reducing the cost and immobility of lead contamination tests, [client] has provided an advanced method of assuring the safety of drinking water, thus significantly benefiting public health.”

Besides recommendation letters, our client’s comprehensive NIW petition dossier contained information on the 39 times his 10 publications were cited as well as detailed descriptions of his research. Overall, we worked hard to present a strong case to the USCIS that highlighted the significance of our client’s work on the synthesis and qualities of various polymeric and pharmaceutical materials. His research in this area is of great importance because it provides improved means of both identifying the role played by different cells in neurodegenerative diseases and monitoring heavy metal contaminants in drinking water.

Despite our meticulous presentation of our client’s strong credentials, the USCIS issued a Request for Evidence (RFE). As soon as we received the RFE, our legal team sprang into action. We promptly responded to the RFE and successfully dealt with all hesitations about our client’s qualifications.

After 8 months and 21 days of deliberation, the USCIS approved our client’s NIW petition. We are pleased that we persuaded them of the importance of our client’s work in biomedical engineering, focusing on nanoscale drug delivery vehicles and mobile environmental monitoring platforms, by developing environmental monitoring devices, particularly to detect toxic heavy metal contaminants.
