Case Summary:
North America Immigration Law Group (NAILG) recently received an approval notice for an EB-2 NIW (National Interest Waiver) petition that we filed on behalf of a vice president from China. The USCIS spent 13.5 months adjudicating the case before granting their approval (based on Matter of Dhanasar*). Despite our meticulous presentation of our client’s strong credentials, the USCIS issued a Request for Evidence (RFE). As soon as we received the RFE, our legal team sprang into action. We promptly responded to the RFE and successfully dealt with all hesitations about our client’s qualifications.
One of the first steps we took was to analyze our client’s credentials, and once we concluded that we could help him obtain the national interest waiver, we established an attorney-client relationship and included the following information in his NIW petition packet:

A detailed account of his research that focuses on the design and development of information systems for business applications. We demonstrated that his research in this area is of great importance for the support and advancement of business management.

We noted his 3 peer-reviewed journal articles and 6 conference articles (3 of them first-authored) that showcased his consistent contributions to the field. The fact that these publications had been cited a total of 103 times at the time of filing proved that his work is of immense value to other researchers in the field. In addition to that, he had also conducted at least 6 peer reviews for several renowned journals.

Most importantly, we included several recommendation letters that testified to his credentials and reiterated our arguments that our client’s work greatly benefits the United States. A recommender wrote: “Each of [client’s] original approaches has impacted the economy and relevant technology with a subsequent benefit to the United States. He is well suited to continue his work in information systems with the ultimate outcome of continuing to improve the field in the United States.”
