On March 17th, 2017, we received another EB-2 NIW (National Interest Waiver) approval for a Senior Device Engineer in the Field of Electrical Engineering (Approval Notice).

Case Summary:
A senior device engineer from China initially approached North America Immigration Law Group (NAILG) to help him file an I-140 petition under EB-1B (Outstanding Professors and Researchers). However, after determining that our client’s employer was not suitably qualified to sponsor him for an EB1B petition, we advised our client to file his I-140 under EB-2 NIW (National Interest Waiver) instead. Some of the pertinent points we included in his NIW petition packet included:
- We documented our client’s publication and citation record. At the time of filing, he had 5 peer-reviewed journal and conference articles to his name, which collectively had obtained a total of 27 citations.
- Our client also had four U.S. patents to his credit. Moreover, he had reviewed two manuscripts on behalf of two top-tier scientific journals.
- In order to fortify our client’s case, we advised him to collect recommendation letters from other experts in the field of electrical engineering. An excerpt from one of the 6 letters he managed to collect stated: “Without question, [Client] is highly trained and accomplished in electrical engineering, possessing a rare level of expertise that has long supported his work in generating cutting-edge techniques and tools for devising seamless power electronics.” Similar words of appreciation and acknowledgement of our client’s research proved beyond any doubt that he was suitably qualified for the national interest waiver.
- We also emphasized our client’s research on designing and developing advanced semiconductor devices in power electronics applications for improved power management in high frequency, high current density applications. Moreover, we demonstrated that he had improvised novel models for visualizing performance of lateral power metal–oxide–semiconductor field-effect transistors (MOSFETs). Overall, we proved to the adjudicating authorities that our client’s research directly contributes to power electronics and microelectronics, as well as to the consumer electronics and semiconductor industries in the United States.
After assembling an NIW petition supported by all the required documents, we filed it on our client’s behalf. When we had not heard back from the USCIS over 9 months later, we raised a service request on our client’s behalf and subsequently followed up on it. Despite waiting close to 11 months, our client finally received notification of NIW approval. We congratulate our client for obtaining the national interest waiver and wish him the best as he continues to conduct impactful research in the field of electrical engineering.
