North America Immigration Law Group was hired by a California-based postdoctoral scholar to help him in filing an I-140 NIW (National Interest Waiver) petition for representing his case. We observed that our client qualifies as a member of the professions holding an advanced degree, a Ph.D. in chemistry, and as an expert in the field of biological chemistry for 6 years, he intends to investigate the use of fluorescence imaging by developing bright, near-infrared emitting molecules and testing imaging systems on animal models to improve the available methods of diagnostic imaging in clinical applications. Besides, we observed the 13 times he reviewed the work of his peers as a peer-reviewer for highly acclaimed journals. Since only the most highly esteemed researchers in the field are invited to assess the work of other experts, especially in authoritative journals, this further proves that our client is seen as very knowledgeable in the field.
Moreover, in recognition of the value and importance of his work, we specified that his proposed project has also been granted funding by the U.S. National Institutes of Health (NIH). This financial support from such a noble organization speaks to the reliability and value of his research in achieving national interests.
Furthermore, along with his employment letter confirming his current position and indicating that funding for his work is expected to continue, we further advised him to provide us with a few recommendation letters from his fellow experts to strengthen the case. Therefore, he was successful in acquiring two such letters of support from independent researchers from around the world; they stated that they have consistently looked to his methods and findings to inform and guide their studies. This also indicates that our client is well-positioned to make further useful discoveries in the field of biological chemistry.
Pleasingly, we proved to the USCIS that his invaluable contributions to the field would benefit the United States even assuming other qualified U.S. workers are available, thus after 7 months and 15 days, the USCIS approved his NIW petition.
