Success Stories: We Helped a Cardiology Fellow in the Field of Biomedical Science Obtain EB-1A Petition Approval Despite an RFE

Client’s Testimonial:

“I do appreciate your work on my case.”

On March 13th, 2017, we received another EB-1A (Alien of Extraordinary Ability) approval for a Cardiology Fellow in the Field of Biomedical Science (Approval Notice).

General Field: Biomedical Science

Position at the Time of Case Filing: Cardiology Fellow

Country of Origin: China

State of Residence at the Time of Filing: Tennessee

Approval Notice Date: March 13th, 2017

Processing Time: 81 days (Premium Processing Requested)

Case Summary:

A cardiology fellow working at a prominent medical institution in the United States contacted North America Immigration Law Group (WeGreened.com) to help her file an EB-1A petition. She possesses a medical degree obtained from her birth country of China and has years of experience in the field of biomedical science. Her work leads to potential applications such as the development of more powerful and safer chemotherapy agents that treat cancers resistant to conventional forms of treatment, as well as the improvement of cardiovascular health in patients during and after their cancer treatment procedures. Undoubtedly, these areas of expertise are beneficial to the United States and it was our job to prove it to the USCIS. As the first step in handling her case, we analyzed her credentials and selected the following points to emphasize in the EB1A presentation:

– At the time of filing, our client’s work had gathered a citation count of 96. This indicated that her findings were benefitting other researchers working in the field of biomedical science. She had also published 13 peer-reviewed scientific articles and 2 abstracts. Additionally, the fact that our client had been invited to review 13 papers highlighted her high standing in the field.

– Our client collected 6 letters of recommendation from esteemed academicians working in the field of biomedical science. These letters were included in her EB-1A petition packet to further fortify her case. The content of one of these letters goes like this: …….her strong educational background, which has given her experience in both medicine and science, affords her a unique understanding of the applications of biomedical findings in patient care. This allows her to rise above many of her peers and make discoveries that are not only interesting scientifically but are also relevant to the improvement of human health.” Similar words of appreciation in the other letters endorsed our client’s eligibility for an EB1A approval.

We filed our client’s case using Premium Processing (PP), which calls for action to be taken on the case within 15 days (it normally takes between 4 to 9 months). Unfortunately, our client’s EB-1A petition was issued a Request for Evidence (RFE). Even so, the adept handling of the RFE by our firm ensured that the EB1A was approved roughly 2 months after the RFE was issued.

Our client was satisfied with the professionalism with which our firm had handled her case and decided to retain us to help with the I-485. We assure her of our full support and thank her for trusting our firm to help her and her spouse obtain their green cards.
