Case Summary:
A gifted postdoctoral research associate from India engaged the services of North America Immigration Law Group (WeGreened.com) to help him obtain a green card. After evaluating our client’s credentials, we verified that he could file his I-140 petition under the EB-1A (Alien of Extraordinary Ability) visa category.
Premium Processing:
Although we initially filed our client’s EB-1A petition using regular processing, he elected to upgrade his case to Premium Processing (PP) less than two weeks later. The best part about filing one’s case under PP is taking advantage of rapid adjudication as immigration officers have to take action on PP case within 15 days (the USCIS adjudicated our client’s case in 13 days). Although the USCIS charges an additional $1,225 on top of their usual filing fees, PP makes perfect sense if one is reluctant to wait 4-9 months for a response from the USCIS.
EB-1A Petition:
As with all our cases, we went to great lengths to ensure that we built a strong I-140 presentation for our client. In this EB1A case, we included all the relevant information that shed light on our client’s various accomplishments. We were sure to include a copy of our client’s advanced degrees, information on the 280 citations to his work, his 17 publications, and the 40 time he conducted peer reviews for high impact scientific journals. We summarized these accomplishments into a petition letter and convinced the USCIS that our client’s development of innovative methods to expand computational drug discovery capabilities is essential to the United States, particularly its pharmaceutical and medical sectors.
Our petition packet also contained letters of support provided by our client’s peers in the field of medicinal chemistry. Six of these experts contributed recommendation letters that upheld our argument that our client’s research efforts are essential to the nation. According to one of these experts: “[Client’s] work is crucial to the advancement of cancer research and cancer treatment strategies. His studies have produced major discoveries regarding potent chemical compounds with therapeutic applications, and have greatly facilitated the development of new drug therapies. The benefits of this research cannot be overstated, as there is a dire and continual need for the development of new cancer therapeutics. The ongoing development of drug treatment strategies is vital to the eventual development of a cure for cancer. In summary, I strongly support [Client].”
