On February 26th, 2016, we received another EB-1A (Alien of Extraordinary Ability) approval for a Postdoctoral Fellow in the Field of Systems Biology (Approval Notice).

General Field: Systems Biology

Position at the Time of Case Filing: Postdoctoral Fellow

Country of Origin: India

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: Texas

Approval Notice Date: February 26th, 2016

Processing Time: 13 months, 2 days

Case Summary:

A postdoctoral fellow immersed in the field of systems biology sought our legal expertise to help her get a green card. She engaged the services of North America Immigration Law Group (WeGreened.com) as she knew about our firm’s strong reputation and outstanding approval rates. As expected, our legal team worked efficiently and effectively, which resulted in two approval notices: one for our client’s EB-2 NIW petition, and the other for her EB-1A (Alien of Extraordinary Ability) petition. It is not uncommon for clients to file two petitions under different visa categories as it gives them twice the chance of getting an approval notice from the USCIS. In this case, both our client’s petitions were approved. All she has to do now is file her I-485 application (final step in the green card process). Once that is approved, she will become an American permanent resident.

Case Details:

Part of our services entailed helping our client select several potential recommenders who were willing to lend their support for her EB-1A case. We narrowed down the list to six recommenders, and to our delight, all of them agreed to help our client. Their detailed testimonials were included in our comprehensive petition packet, and they furnished the USCIS with evidence that our client is an asset to the United States. For instance, one of the recommenders—a prominent professor in the field—said this about our client: “[Client], as a preeminent metabolomics scientist, has already demonstrated her unmatched strengths in this area, making her one of the most valued individuals working in this vital area of research. Considering that cancer is one of the most common deadly diseases, as well as one of the most costly to treat long-term, it is patently obvious that the extension of [Client’s] research is broadly beneficial.”

Besides recommendation letters, we also documented the 69 citations to our client’s 8 published papers and the 9 times she conducted peer reviews for high impact scientific journals.

Challenges Faced:

The biggest challenge that we faced was the wait time we were subjected to. The USCIS spent over 13 months adjudicating this EB-1A case (average processing time is between 4-9 months) and overall, we raised one service request on our client’s behalf. A little over a week after we received a reply from the USCIS informing us that our client’s case was undergoing additional review, we received the long-awaited approval notice.

We join our client in celebrating this momentous occasion, and we thank her for selecting our firm to guide her on the journey towards her green card.
