Case Summary:

Just 13 days after North America Immigration Law Group (NAILG) filed an EB-1A (Alien of Extraordinary Ability) petition on behalf of a project lead from China, the USCIS approved his case. With a doctorate in geophysics and extensive experience conducting research in the same field, our client was a good candidate for this visa category.

Building a strong case:

Our legal team and support staff worked diligently to put together a strong EB-1A petition packet for our client. By the time we were ready to file the case, we had amassed a wealth of information related to his professional experience and academic achievements. Amongst other things, we documented the 8 peer-reviewed scientific articles and 17 conference papers to his name as well as the impressive 30 times he assessed the work of his peers for scientific journals. To top it all off, we listed the 127 times his work had been cited by other researchers at the time of filing.

To strengthen our client’s EB-1A petition, we prompted him to contact a handful of other expert geophysicists and ask them to sign recommendation letters. These letters were included in his petition packet and served as additional evidence to support his case. In one of these letters, our client’s research was described as “…vital for meeting both current needs for oil resources and future demands for new sites. Because the United States is one of the world’s largest consumers of oil, the country would benefit greatly from [Client’s] uninterrupted efforts in the field.”

Because our client chose to file his case under Premium Processing, the adjudication timeline amounted to less than two weeks. Even better than that, the USCIS did not issue a Request for Evidence (RFE). We are pleased that our client passed this significant hurdle in the green card process, and we wish him the best with the final step: filing an I-485 application to adjust his status for permanent residence.
