Case Summary:

Our client, an outstanding lead CAE integration manager in the field of mechanical engineering, has an advanced degree professional under his doctor of philosophy degree in mechanical engineering, which he received from a well-known Netherlands university.

Our client contacted us for his NIW petition. Our knowledgeable attorneys thoroughly evaluated his background information and tailored a petition package to his specific needs. We were successful in claiming that he used his remarkable research expertise to produce numerous significant advances in the field of mechanical engineering. This field of research was important due to the crucial role that such advances would play in developing ultra-efficient topologies and algorithms for inverter technologies to facilitate the construction of long-range hybrid and battery-powered electric vehicles. His research field was one of substantial intrinsic merit for its capacity to reduce oil imports, minimize air pollution-related health costs, and forge new manufacturing opportunities and job creation in the electric power generation, transmission, and distribution sectors.

Through the continued implementation and dissemination of his research, the benefits would impact all parts of the nation. We also provided all of the documentation demonstrating his exceptional research abilities, as well as strong letters of recommendation from major professionals in his area attesting to his status as one of the best researchers in his field.

In July 2023, we submitted his NIW (National Interest Waiver) petition to USCIS, which was approved in just 3 days. Our client’s outstanding petition package was adjudicated quickly and successfully thanks to USCIS’s premium processing service (a paid option offered by the USCIS that allows petitioners to enjoy accelerated adjudication within 15 days instead of 9-12 months).

Impressed with our dedicated teamwork on his NIW petition, our client retained us to file another petition under the I-140 EB1A (Alien of Extraordinary Ability) visa category a month after NIW approval. We decided to take on his EB1A case since we were aware of his remarkable scientific background.

We highlighted his meticulous record of 29 peer-reviewed journal articles and conference papers and 4 technical papers published in some of the most discerning, high-impact journals in the field of mechanical engineering, which altogether accumulated 284 citations, establishing the impact that he has had on his peers and colleagues. Moreover, he has conducted 5 reviews to date, demonstrating his active and genuine engagement as a judge of the work of other experts in the area.

Unfortunately, his EB1A petition package received an RFE (request for evidence), probing into the qualifying validity of the application’s claims for satisfying the extraordinary ability criteria. But in no time, we countered with our RFE response package. Our goal was to achieve the most challenging requirement in obtaining EB1A approval, which is to prove the alien’s national and international acclaim with recognized achievements. We were thus soon able to compile an outstanding list of his accomplishments, including his publication and citation records, peerreview experience, and funding support for his work from the Dutch Technology Foundation STW, UK-Indian Education and Research Initiative, Innovate UK, proving his exceptional ability as well as his national and international importance to the United States.

We are pleased that we were able to provide USCIS with all the relevant information of our client’s research, which is therefore tremendously beneficial to the United States’ continued battle for global emission reduction goals. As a result, he received his EB1A approval in November 2023 despite receiving an RFE. Two wonderful approval (NIW and EB1A) stories in a row this year have made us wish our client the best of success in his future pursuits.
