Case Summary:

Our client, a chemist from India, has made substantial contributions to the important field of environmental chemistry. If anything, her various achievements are enough to prove her worth to the United States and thus, help her obtain an EB-1A (Alien of Extraordinary Ability) petition approval. North America Immigration Law Group (NAILG) was tasked to do just that. We needed to persuade the USCIS that our client is an asset to the U.S. and that her findings are advantageous to the nation. Like any legal battle, we had to compile evidence to prove these claims. Here are some of the main things we focused on:

  1. Citation Count: We used Google Scholar to determine our client’s citation count at the time of filing: 141 citations. These citations proved that her work is being utilized by other researchers to progress the field as a whole.
  2. Peer Review Record: When we filed the case, our client’s peer review record stood at 21 reviews in total. Not only had she reviewed her peers’ manuscripts, she had also reviewed their conference papers.
  3. Number of Publications: We also detailed our client’s 11 published articles, all of which appeared in well-known scientific journals. Her publication record spoke volumes of the fact that her work is recognized by other environmental chemists.
  4. Research Evidence: Our client’s Ph.D. in Environmental Science and Engineering has enabled her to carry out impactful research. Her work is focused on investigating the impact of engineered nanoparticles (NPs) on the environment. We carefully accounted for her research projects and concluded that they directly contribute to the management of environmental pollutants and protection of natural resources, food products, and global ecosystems through an in-depth knowledge of the environmental behaviors of released NPs. Her research ultimately affects the United States’ manufacturing, industrial, commercial, and economic sectors and the environment.
  5. Recommendation Letters: Our client’s role in the field was described as “… an influential role in advancing nanotoxicology research at an international scale. Her findings are as relevant to worldwide food webs and environmental security concerns as they are to the work of the United States’ agricultural, manufacturing, and environmental leaders and stakeholders. To produce sustainable, ecofriendly nanoparticle-infused products, domestic or international companies require research led by experts in the field. [Client] has demonstrated just such expertise in her characterization and identification of nanoparticle behaviors in a number of important agro-environmental contexts . . . Hers is a reputation of scholastic distinction and applied, hands-on research that deals directly with alleviating the pressures of commercial and manufacturing industries on life-sustaining ecosystems.” This statement was taken from a recommendation letter signed by an influential chemist in the United States. He was not alone in his show of support of our client’s EB-1A petition and was joined by several other experts in the field, all of whom signed recommendation letters which we incorporated into our client’s petition dossier.

The USCIS spent 2 months and 24 days adjudicating our client’s EB-1A petition before granting their approval. It would have taken several more months had she not elected to upgrade her case to Premium Processing (PP). This add-on option trimmed down the overall processing timeline and our client received notification of petition approval just 8 days after the upgrade. We recently helped our client and her dependent file I-485 applications to adjust their status for permanent residence. Once approved, they will obtain their green cards.
