On March 9th, 2016, we received EB-1A (Alien of Extraordinary Ability) and EB-2 NIW (National Interest Waiver) approvals for an Assistant Professor in the Field of Pharmacology (Approval Notice).

Case Summary:
A well-known assistant professor from India hired North America Immigration Law Group (WeGreened.com) to file two I-140 petitions on her behalf: EB-1A (Alien of Extraordinary Ability) and EB-2 NIW (National Interest Waiver). It is not unusual for our clients to file dual petitions as it increases their chances of attaining an approval notice from the USCIS: if one petition is denied, the other may still be approved. In this case, our client received two approval notices.
Significance of Current Priority Dates:
We are particularly pleased that our client’s EB-1A petition was approved because now, she does not have to wait for her priority date to become current before embarking on the final step of her green card journey: the I-485 application. For petitioners born in India with EB-2 petitions that were recently filed and approved, they have to wait for their priority date to become current before filing their I-485 application (this has to do with the quota system set by the USCIS). As there is no quota in place for EB-1 petitions, our client can file her I-485 application whenever she wants.
I-140 Petition Packets:
Here are several of the overlapping details found in our client’s EB-1A and NIW petition packets:
- Credentials: Our legal team included our client’s vast credentials in both petition packets. This included her peer review experience (4 reviews), citation count (109 citations), and publication record (12 scientific articles, 18 abstracts, and numerous conference presentations).
- Recommendation letters: The several recommendation letters that our client managed to gather from other experts in her field of pharmacology were incorporated into both petition packets. They were used to strengthen the petitions and to verify our claim that our client’s work is important to the United States. For instance, one of these letters stated, in part, that “[Client] has performed amazing work for the field of pharmaceutical research, and she must be allowed to continue, because without her, this field would suffer a great loss in its ability to continue making the progress necessary to save those lives and the economical backlash thereof. As such, I strongly recommend that [Client] continue her research for the betterment of the health of this country’s citizens and for the field of pharmaceutical research.”
- Research findings: Part of our services included reviewing and accounting for our client’s various research ventures on pulmonary and cardiovascular pharmacology, particularly in regards to asthma. We determined that our client’s strong academic and research background has allowed her to achieve groundbreaking results—such as the identification of new targets for asthma therapies. We convinced the USCIS that her work impacts the American healthcare system, and that not many other researchers can attain the same level of success as our client.
Final Step:
We are currently helping our client prepare the necessary paperwork for her I-485 application. Once the USCIS approves this final step, our client will receive her green card.
