General Field: Pharmaceutical Engineering

Position at the Time of Case Filing: Research Associate

Country of Origin: China

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: Kentucky

Approval Notice Date: April 16, 2015

Processing Time: 5 Months, 10 Days

Case Summary:

In this case, the client that we had the opportunity to work with was a research associate from China in the field of pharmaceutical engineering. Her specialized research has focused on nanomedicine and nanoparticulate drug delivery systems. Her work had resulted in 33 peer-reviewed scientific articles and 4 abstracts/presentations at national and international conferences; at the time that her case was filed, her publications had been cited at least 263 times by independent and leading researchers from prestigious institutions and organizations around the world, indicating the major significance of her work. She had also reviewed 27 manuscripts for distinctive, internationally-circulated journals.  Her superior level of expertise was confirmed in the following quote from an independent recommender, “The continuance of [client’s] research is indisputably critical for advancements in the treatment of medical conditions like pulmonary infections, asthma, and lung cancer from which millions suffer and millions die on a global scale.” It was our goal to prove that our client qualified for classification as an Alien of Extraordinary Ability given that she sought to remain in the United States to continue work in the area of pharmaceutical engineering, and that her continued research would substantially and prospectively benefit the United States. With the proof and documentation that we provided, her case was approved in 5 months and 10 days.

The overall approval rate for all NIW, EB1A and EB1B* “Approval or Refund®” cases is 98.65%.

*The number of approval notice for EB1B cases is under-estimated of the total EB1B cases we successfully petitioned because many EB1B employer petitioners did not submit G-28 and we are not the attorney on the record.
*In 2014, one of our EB1B cases (regular service) was denied based on an inaccurate adjudication. The case was approved shortly after we re-filed the petition.
*The approval rate statistics only include cases that were originally filed by our law firm and exclude RFE cases that were taken over in the middle from other law firms or DIY clients.
