Case Summary:

Despite the fact that sometimes US Citizenship and Immigration Service officers can be confused about the requirements for EB-1A (Alien of Extraordinary Ability) and issue a Request for Further Evidence (RFE), we received another EB-1A (Alien of Extraordinary Ability) Approval for a Postdoctoral Researcher in the field of Polymer Physics on October 30th, 2013. The client’s work focused on the theoretical structure and properties of polymeric materials, and we argued that his work had impacted not only the field of materials science but the countless industries that rely upon the development of new materials. At the time of filing, his work had resulted in 18 peer-reviewed articles that had accumulated at least 193 citations from researchers around the world, demonstrating the influence and international acclaim of his work. Additionally, his services as a peer-reviewer had been requested by five top-tier journals in the field, and he had conducted 15 paper reviews.

The RFE stated that the client had met both the criterion for “judge of the work of others” and “authorship of scholarly articles”. The RFE challenged that the client had made original contributions of “major significance”, citing that the recommendation letters that had been provided lacked details of specific instances of the implementation as well as details about the client’s role in the research projects he had participated in. In order to satisfy the RFE, we drafted 4 more recommendation letters for the client including rich details about specific instances of the implementation of the his work, as well as his specific role in his research projects. Since the original case was filed with a request for Premium Processing, the 15 day time period applied to the adjudication of the RFE response as well. 10 days after submitting the RFE response, the case was successfully approved. Ultimately, perseverance and detailed evidence satisfied the RFE unambiguously in our clients favor.
