Case Summary:

While the O1A visa benefits aliens of extraordinary ability in the sciences, arts, education, business, or athletics, those foreign nationals should at least have:

• Sustained national/international claim;
• Their achievement must be recognized in the field through extensive documentation;
• Current/previous employment in a critical or essential capacity for organizations or establishments with a distinguished reputation.

The NIW petitioners on the other hand must fulfill the below-mentioned prerequisites:

• The foreign national must be in a position to advance the proposed endeavor;
• The applicant must present evidence that the U.S. would benefit on balance to waive the job offer criteria for an EB-2;
• A proposed endeavor, holding substantial merit and national importance.

After completing his PhD in technology for health, our client, a battery materials specialist from Italy, approached us to file his NIW (National Interest Waiver) and O1A (Individuals with Extraordinary Ability or Achievement) petitions on his behalf.

His research addresses some of our nation’s most pressing issues in understanding how to produce phosphates and extract valuable and toxic metals from used batteries in an environmentally friendly manner. His strong background in critical resource recovery, environmental sustainability assessment, and material characterization and optimization has made his research particularly original, with applications such as novel air and water purification and battery recycling methods.

Furthermore, his study has received funding from ERA-MIN 2, the Ministry of the Environment and Protection of Land and Sea – Direzione Generale per i Rifiuti e L’Inquinamento. This support of the client’s research therefore serves as evidence that his work promotes the production of sustainable cleaning technologies to conserve human and environmental health. Indeed, his work advances the use of eco-friendly methods for removing micropollutants from both air and water, a major boon to environmental health.

Consequently, to make a strong case in his favor, we included the following details in his petition packet:

• His work has resulted in at least 17 peer-reviewed scientific articles (8 of them first-authored), 1 accepted journal article, and 1 first-authored book chapter.
• His publications have been cited at least 201 times according to Google Scholar.
• He has completed at least 18 peer reviews.
