Case Summary:

North America Immigration Law Group has a longstanding history of helping foreign nationals obtain immigrant status in the United States through EB1, EB2, O1, and other types of visa processing. Our firm has helped over 25,000 clients obtain various kinds of nonimmigrant and immigrant visas over time. This experience has enriched our team and allowed us to be thorough with our work. So, when a postdoctoral research fellow from India approached us for her EB1-A (Alien of Extraordinary Ability) application, our team had their job cut out for them.

They instinctively started their work by checking background details and collecting relevant documents available. This included both academic and professional documents such as her updated CVs, transcripts, certificates, testimonials, recommendation letters, records of publication and citations, etc. This facilitated the making of a petition packet that would certainly be victorious. • Details of her research work show that she is one of the few leading fungal infections and antifungal resistance experts in medical mycology, and she has achieved a consistent and notable record of success and influence in these areas of study. We showed that she is especially well-known for her discovery of a new Candida auris strain in India and her identification of the molecular mechanisms of C. auris drug resistance.
• The field has recognized her authority by inviting her to review and evaluate the work of her peers no fewer than 33 times.
• She has also actively engaged her peers in the field of medical mycology by authoring and co-authoring 30 peer-reviewed journal articles and 1 book chapter that have been published in international journals.
• Due to its great applicability in the field, her research has been cited a massive 3,051 times in at least 73 countries according to Google Scholar. This has made her one of the top 1% of the most highly cited authors publishing on topics in biology, chemistry, and medicine over the past 9 years according to Microsoft Academic.
• Finally, she was able to collect 4 letters of support from experts in her field who corroborated the value of her work. These letters helped her case immensely by advocating the expertise that she brings to the table. Two of these recommendations said the following:

“There are few scientists in the field of medical mycology who have attained [the client’s] level of expertise. Her work on antifungal drug resistance has been uniquely valuable to her fellow researchers and to everyone working to improve public health in the U.S. I therefore strongly support her continued research in the United States.”

“[The client’s] identification of the genetic correlation of resistance in these species represents a pivotal advancement in the effort to overcome antifungal resistance. Considering the burden fungal infections place on the United States healthcare system, [client’s] research on the resistance mechanisms of fungal species is crucial to safeguarding the health of people including Americans who are susceptible to these infections.”

It was thus clear to us that it will be extremely difficult, if not impossible, to find another researcher who can mirror her contributions to this nationally imperative research field. Experts agreed that her continued participation is critical to the overall success of efforts to combat the detrimental impacts of drug-resistant fungal infections in the field of endeavor. So, we were able to make sure that her petition indicated that not only does she qualify as an alien of extraordinary ability but also that her entry will substantially benefit prospectively the United States.
