Case Summary:

Our client, an adjunct assistant professor from Canada, engaged the services of North America Immigration Law Group back in 2020 to help him prepare his EB-2 NIW (National Interest Waiver) petition. We then reviewed all the documentation he had submitted to amend and correct it, although we were pretty impressed with what he had done so far. The key points we had to focus on while preparing his NIW petition packet were that the petitioner must possess at least one of the following minimum requirements:

  • A U.S. master’s degree or higher (or its foreign equivalent), or
  • The proposed endeavor has both substantial merit and national importance;
  • The applicant is well-positioned to advance the proposed endeavor; and
  • On balance, it would be beneficial to the United States to waive the requirements of a job offer and thus of a labor certification.
  • We headed on discovering that after completing his M.Sc. in physics, he intended to pursue his Ph.D. and continue his research in the field of physics here in the United States. Therefore, we delved into his research background, which focuses on developing improved theoretical models to calculate orbital debris behavior and secure real-time data on space debris. His research seemed relevant to advances in fluid flow modeling, condensed matter physics, and space propulsion systems.
  • In addition, his proposed initiative has overall implications for the United States. Since he has also researched space propulsion systems, a key area of research for government agencies such as NASA and the National Space Council. Undoubtedly, his research is in line with national objectives regarding space travel, thereby demonstrating the irrefutable significance of his work for the country.
  • He has also built an impressive record of success throughout his time working in the field: –
  • 19 peer-reviewed journal and conference articles (16 of them first-authored) he published in numerous authoritative journals. Upon noticing his history of publication in highly selective conferences and journals, it is evident that his research is highly regarded in the field of physics.
  • His influence as a physicist lies in his first-class citation record. Thus, we noted that his works accumulated 28 citations by other physicists around the world, reaffirming his status as a physicist of international repute and importance.
  • As an additional testament to his impact on the scientific literature, he has completed 24 peer reviews for highly acclaimed journals and established himself as a trusted authority in the field of physics.

After successfully securing his NIW approval from USCIS, he retained us to help him file his I-485 application as well. Compared to obtaining a national interest waiver, acquiring a green card was relatively simple to process because we already had most of the information we needed to combine while filing for his I-485 case.
