General Field: Organic Chemistry
Position at the Time of Case Filing: Research Associate
Country of Origin: India
State of Residence at the Time of Filing: Mississippi
Approval Notice Date: April 16th, 2021
Processing Time: 11 months, 23 days
Case Summary:
North America Immigration Law Group was approached to file an EB-2 NIW (National Interest Waiver) petition for a research associate holding a doctorate of philosophy in organic chemistry researching the same field for several years. Given our experience, we assess our client’s testimonies to make sure if the candidature is suitable for the applied visa. After the evaluation, we were sure of our client’s credentials, and we agreed to move him to the national interest waiver success. While his NIW petition was still pending, our client decided to retain our services for another visa under the I-140 EB-1A category. Victoriously, his EB-1A case got approved back in 2020. However, we had to wait for 11 months and 23 days to get the NIW approval. Despite a long wait, our client achieved the NIW approval without any request for additional evidence.
Thus, here are some of the details we added in the petition packets:
- We reviewed his research focusing on the design and development of improved synthesis methods and novel organometallic complexes for energy-efficient materials, concluding its great importance of facilitating progress in a relatively new but increasingly important area of research, namely green chemistry.
- In addition, we noted the 206 citations accumulated from the 8 peer-reviewed journal articles (3 of them first-authored) he published. His citation record determines that he has a major influence on other scholars’ from at least 30 countries, thereby demonstrating that these publications are widely recognized and relied upon in the field of organic chemistry. Moreover, our client has completed 15 peer reviews, embodying that he is an active member of the scientific community and a keystone researcher in the field of organic chemistry.
- To strengthen his case further, we added five recommendation letters that he gathered from other leading experts in the field, emphasizing his influential position as a researcher providing highly relevant findings in the field. The following excerpt has been extracted from one of the letters:
“[Client’s] research has optimized a next-generation, environmentally sound catalysts for use in chemistry in pharmaceuticals and biofuels, therefore his work must be supported to reduce pollution at the source point. He has also been the recipient of global acclaim in the form of his publications and citations and his inclusion in others’ works surely upholds his status as an influential member of the organic chemistry research community. The continuation of his research in the United States is therefore imperative to the advancement of green chemistry, the field of organic chemistry itself, and the health of the environment.”
We are delighted to be able to convince the USCIS of how our client is significant to organic chemistry and the global community in improving environmental impacts, economic costs, and health of laboratory workers as well as the public. Fortuitously, our client received the NIW approval, and we truly thank him for choosing our law firm to manage his I-140 applications.
