Case Summary:
North America Immigration Law Group was hired by a postdoctoral researcher based in Colorado to file an EB-2 NIW (National Interest Waiver) petition. We evaluated his academic accolades and planned research work in the field of biomechanics, and we checked that he held a Ph.D. in biomechanical engineering and intends to advance his work on developing advanced anatomic models for the improvement of joint prostheses, bone prostheses, and other orthopedic devices. His research work in the field is of great importance because it greatly contributes to the scientific and medical communities’ understanding of extremely delicate joints, such as spines and knees, proving its relevance to the improved treatment of orthopedic conditions such as spinal cord injuries, knee replacements, and hip replacements.
Moreover, we added the 40 citations accumulated from 6 peer-reviewed journal articles (5 of them first-authored), one peer-reviewed conference article (first-authored), and 12 peer-reviewed conference abstracts (9 of them first-authored) he published, inspiring other acknowledged researchers. Also, we noted that he has conducted at least 8 peer reviews for top-notch journals, which proves his active and actual participation as a professional judge of the work of other experts in the biomechanics field.
Furthermore, we specified that his work is so advanced as it was granted funding by DePuy Synthes. As a leading private company, this funding demonstrates that our client’s work is useful to the private sector as well as the biomechanics research community. The utilization of his work in this way confirms its major significance to his field and to the practical use of medicine as well, therefore, signifying the national importance of his research.
To strengthen his built case, we added his employment letter confirming his current position, an offer letter confirming his upcoming position, and five recommendation letters that he obtained from other scholars in the field, establishing that our client’s research is of crucial importance to the United States. Also, one of the recommenders stated the following:
“[Client’s] ongoing research contributions, therefore, hold great value for the biomechanics field and the scientific community at large, in our nation and worldwide. By advancing our understanding of the human body’s structure and interactions, he provides biomechanics researchers with new ways of addressing and treating injuries, improving the performance of procedures like knee implants and the safety and comfort of patients undergoing such procedures.”
Once more our team’s efforts in customizing this petition packet proved to be successful. The USCIS was convinced that our client’s research consistently identifies and fixes shortcomings in the concepts, allowing other biomechanics researchers across the country to improve their treatments, implant designs, and surgical procedures. Thus, he was granted his EB-2 NIW approval. We thank our client for choosing our law firm for his NIW case preparation and cooperating with us throughout this long duration of his case adjudication.
