Case Summary:

Exactly 7 months and 22 days after we filed an EB-2 NIW (National Interest Waiver) petition on behalf of a software engineer from Malaysia, the USCIS approved his case. At first glance, our client was suitably qualified for the national interest waiver as amongst other things, he possessed a M.S. in Computational Physics as well as many years of experience researching the same field.

Assembling a Strong NIW Petition:

Part of the process in getting our client closer to his green card involved presenting his various achievements to the USCIS. These were several of the points we focused on:

• We noted our client’s significant citation record: at the time of filing, he already had 208 citations to his published research. Moreover, he had 4 peer-reviewed journal articles (1 of them scheduled for publication, 2 of them first-authored), which we highlighted in the petition.
• Our client’s work is concentrated specifically on the development of safe and transparent human-level artificial intelligence to aid scientific research and on the development of an all-encompassing theoretical framework of physics that can fully explain all aspects of physical phenomena of the universe. His research in this area is of great importance because it involves implementing machine learning and artificial intelligence techniques for categorizing electronic quantum matter, which enables the discovery of other quantum phenomena. His contributions to artificial intelligence are invaluable, given the rising interest in this technology. In a nutshell, we clearly demonstrated to the USCIS that our client’s findings have a profound impact in the field of physics.
• Of additional significance were the 6 recommendation letters that were signed by our client’s peers, all of which were included in our client’s well planned NIW dossier. One of these letters stated: “[Client’s] developments are therefore valuable, insofar as they fuel the discovery of new materials and technologies, as well as lower economic burdens for the U.S. The United States presently spends over 150 billion dollars per year on the development of new technologies, so [client’s] efforts to improve efficiency in machine learning provides crucial benefits for both the theoretical physics research community and the United States economy.”
