Success Stories: NIW Petition Approved Without RFE for Chinese Postdoctoral Research Fellow in the Field of Chemistry

Client’s Testimonial:

“Thanks very much again for helping me with this process. I’m looking forward to work with you for my i485/non-immigration visa part.”

On January 15th, 2020, we received another NIW (National Interest Waiver) approval for a Postdoctoral Research Fellow in the Field of Chemistry (Approval Notice).

General Field: Chemistry

Position at the Time of Case Filing: Postdoctoral Research Fellow

Country of Origin: China

State of Residence at the Time of Filing: Pennsylvania

Approval Notice Date: January 15th, 2020

Processing Time: 8 months, 22 days

Case Summary:

Exactly 8 months and 22 days after we filed an EB-2 NIW (National Interest Waiver) petition on behalf of a postdoctoral research associate from China, the USCIS approved her case. At first glance, our client was suitably qualified for the national interest waiver as amongst other things, she possessed a Ph.D. in chemistry as well as many years of experience researching the same field.

Assembling a Strong NIW Petition:

Part of the process in getting our client closer to her green card involved presenting her various achievements to the USCIS. These were several of the points we focused on:

  • We noted our client’s significant citation record: at the time of filing, she already had 131 citations to her published research. Moreover, she had 4 peer-reviewed journal articles (2 of them first-authored), which we highlighted in the petition.
  • Our client’s work is concentrated specifically on quantitative analysis and the development of techniques for chemistry education. Her extensive research on palladium nanoparticle synthesis is of great importance to the field of chemistry because palladium is a key catalyst required to process petroleum. Her work is also important to students around the world as it provides relevant strategies for scientific learning. In a nutshell, we clearly demonstrated to the USCIS that our client’s findings have a profound impact in the field of chemistry.
  • Of additional significance were the 4 recommendation letters that were signed by our client’s peers, all of which were included in our client’s well planned NIW dossier. One of these letters stated: “One researcher who has made substantial headway to this end is [client]. In her articles on chemistry education, [client] has refined our understanding of how college-level students in introductory courses learn abstract material through hands-on laboratory experience. Her research is central as we continue to develop educational methods for STEM students that increase success rates in the short and long term.”

We are pleased to take this opportunity to congratulate our client and wish her the best as she takes the final step towards her green card. We thank her for trusting us for her NIW petition.
