Client’s Testimonial:
“Thank you so much. It’s been great working with your firm. You made my application much more simple!!!”
On July 13th, 2020, we received another NIW (National Interest Waiver) approval for a Postdoctoral Associate in the Field of Geosciences (Approval Notice).
General Field: Geosciences
Position at the Time of Case Filing: Postdoctoral Associate
Country of Origin: Vietnam
Country of Residence at the Time of Filing: Vietnam
Approval Notice Date: July 13th, 2020
Processing Time: 9 months, 12 days
Case Summary:
When a postdoctoral associate from Vietnam specializing in the field of geosciences approached North America Immigration Law Group (NAILG) for help with an EB-2 NIW (National Interest Waiver) petition, we conducted a quick purview of his credentials to affirm his suitability for the national interest waiver. Based on Matter of Dhanasar, the USCIS determined approval based on the substantial merit of our client’s work, its national importance, and how our client is well-positioned to advance the proposed endeavor.
After countersigning the legal agreement, we started the meticulous compilation of an effective NIW dossier. The points we highlighted included:
- We detailed our client’s scholarly contributions including 12 peer-reviewed journal articles (8 of them first-authored) in prominent journals and conferences which had accrued 250 citations at the time of filing.
- The various peer reviews which our client conducted for esteemed journals was noted. Only top-level experts in their field are invited to perform this important review work, so this frequent review activity further demonstrates our client’s important standing in the field of geosciences.
- Our client’s influence in his field, especially pertaining to the complex ecohydrologic systems and vector-borne diseases in the context of climate change was also included in the customized petition packet. His research in this area is of great importance because it elucidates critical information on climate change’s impact on the global ecohydrological system. He has given the field invaluable tools and models to assess the effects of an altered water supply on the Earth’s environment and humans.
- Finally, to establish a solid case, we submitted recommendation letters proffered by 4 other prominent researchers. A highly distinguished professor noted:
“Through his research, [client] is actively growing the body of information available about this crucial subject. Scientists agree that massive alterations to the critical zone have incredibly dangerous penalties for life on Earth. With this in mind, [client’s] research on modeling and simulating the critical zone in the U.S. Midwest is of national importance.”
Collectively, all four experts found our client to be highly deserving of the national interest waiver.
Months of hard work resulted in the NIW approval received by our client 9 months and 12 days after filing. Though the adjudication timeline went beyond the anticipated 4 to 9 months, we are still elated that our client successfully overcame the first hurdle in the green card process. We thank him for trusting our law firm for his NIW petition and, we wish him well as he continues to conduct impactful research here in the US.
