On March 31st, 2020, we received another NIW (National Interest Waiver) approval for a General Surgery Resident in the Field of Pediatric Surgery (Approval Notice).

General Field: Pediatric Surgery

Position at the Time of Case Filing: General Surgery Resident

Country of Origin: Venezuela

State of Residence at the Time of Filing: Texas

Approval Notice Date: March 31st, 2020

Processing Time: 6 months

Case Summary:

A general surgery resident from Venezuela hired North America Immigration Law Group (NAILG) to help him prepare and file a customized EB-2 NIW (National Interest Waiver) petition. Before taking on his case, we carefully went through his credentials to be sure that he met all the requirements set by Matter of Dhanasar (the framework used to determine NIW eligibility).

Once we confirmed that our client was a good fit for NIW, we got to work gathering a wealth of information pertaining to his work in the field of pediatric surgery. We discussed his research on liver fibrosis therapeutic interventions, adipocyte/liver crosstalk in liver steatosis development, and pediatric healthcare disparities in the United States. His research in his area is of great importance because it presents preventative treatment methods for liver disease.

Further, we included recommendation letters signed by other influential members of the pediatric surgery research community. These experts advocated for the approval of our client’s petition and supported our argument that our client should be allowed to remain in the US to continue his research. According to one of these recommenders,

In order to provide enhanced treatments to improve the outcomes of these injuries, the medical community in the U.S. requires the research of [client]. Furthermore, he has provided the medical field with unique standards to treat children with burns. Overall, [client’s] work has largely progressed the known resources to treat burns in the U.S. medical community.

The comprehensive NIW petition packet our team put together contained convincing evidence of the benefits of our client’s research to the United States. It also detailed his citation count (146 citations) and publication record (20 peer-reviewed journal articles (5 first-authored or co-first-authored), 3 case reports, 3 peer-reviewed book chapters (2 first-authored), and 1 first-authored peer commentary) at the time of filing. Further, we noted the 32 peer reviews our client conducted for a well-known scientific journal.

With over 16,000 approved cases, there is no denying that our firm knows just what to do to get clients closer to green card success. Not just that, we are very familiar with USCIS adjudication trends and offer our clients up-to-date advice on a variety of I-140 issues.

We thank our client for working with us and wish him the best as he adjusts his status for permanent residence by filing an I-485 application.
