General Field: Oncology

Country of Origin: India

State of Residence at the Time of Filing: New York

Approval Notice Date: February 1st, 2019

Processing Time: 6 months, 14 days

Case Summary:

An Indian Hematology/Oncology Fellow hired North America Immigration Law Group (NAILG) to assist him with the first step in the green card process. With an MBBS and expansive background of expertise and experience in the field of Oncology, we concluded that our client would meet the standards required for EB-1A (Alien of Extraordinary Ability) petition.

Our client’s research focused on identifying and assessing the efficacy of novel drugs for metastatic cancers, attending to understanding the causes of cancer as well as the best pathways for developing novel cancer treatments. His strong background in conducting clinical research in hematology and oncology has allowed his research to be particularly original, with applications such as the development of safer and more effective cancer therapies.

To put together a strong case, we worked diligently to gather as much information as we could on our client’s work, and also helped our client select recommenders to strengthen his case. We submitted evidence that our client’s work has resulted in 13 peer-reviewed scientific articles, been cited for 82 times at the time of filing and our client has conducted at least 30 reviews for prestigious journals. We also provided 6 letters from experts in the field attesting to the importance and significance of his contributions. One of the experts recommending our client has the following to say regarding his influence on the field: “[Client]’s studies have already been applied by researchers worldwide. […] The consistent level of recognition that [client]’s work has received confirms that he is a researcher who has achieved global respect and influence, and one whom the United States cannot afford to lose”.

Overall, we convinced the USCIS that our client should be allowed to remain in the US to continue his research. Although a Request for Evidence (RFE) was issued, they eventually approved our client’s petition. We congratulate our client for securing the EB1A petition approval and wish him the best in his future research.
