Client’s Testimonial:

“That’s amazing news. I appreciate all your support and professionalism.”

On December 1st, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Research Fellow in the Field of Aerospace Engineering (Approval Notice).

General Field: Aerospace Engineering

Position at the Time of Case Filing: Postdoctoral Research Fellow

Country of Origin: Brazil

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: Indiana

Approval Notice Date: December 1st, 2016

Processing Time: 12 months, 8 days

Case Summary:

Exactly a year and 8 days after North America Immigration Law Group (WeGreened.com) filed an EB-2 NIW (National Interest Waiver) petition for a postdoctoral research fellow from Brazil, the USCIS approved his petition. It usually takes the USCIS between 4-9 months to adjudicate I-140 petitions so when the processing time went beyond the norm, we raised a service request on our client’s behalf. Not long after that, our client received notification of case approval.

In order to prove to the USCIS that our client deserved the national interest waiver, we had to demonstrate his high standing in the field of aerospace engineering. We also had to prove that he is one of only a scant handful of researchers who can attain such impactful research results. To accomplish our goals, these are some of the details we included in our client’s NIW petition packet:

  1. Not only did we note his doctoral degree, we also detailed his research on improving aerospace structures and materials. We persuaded the USCIS that our client’s research results directly contribute to national space programs, as well as the aerospace and automobile industries. Additionally, his research efforts on strain localization and transitions in the failure mechanisms of Nickel-based superalloys at high temperature are contributing to the United States’ turbine engine and related industries.
  2. Our client’s publication record (6 published articles and numerous conference presentations) as well as his citation record (47 citations gathered at the time of filing) were also detailed.
  3. To further fortify our client’s NIW petition, we encouraged him to reach out to his peers for recommendation letters. To our delight, our client returned with six strong letters, one of which contained this statement: “He is unequivocally one of the top tier researchers in his line of work, and the United States should enthusiastically support a scientist with his rare set of talents. Within the United States, [Client] can continue to have the most impact due to the availability of resources for him to continue his groundbreaking work.”

We congratulate our client for overcoming this massive hurdle in the green card process and we wish him the best as he waits for the USCIS to take action on his I-485 application (which he filed with the help of our D.I.Y. Packet). We thank him for working with us and wish him well as he continues to development the field of aerospace engineering in the US.
