On August 11^th, 2016 and March 6^th, 2017 we received another EB-2 NIW (National Interest Waiver) and EB-1A (Alien of Extraordinary Ability) approval for a Data Scientist in the Field of Applied Mathematics (Approval Notice).

Case Summary:

A data scientist from China residing in California hired North America Immigration Law Group (WeGreened.com) to file two I-140 petitions on his behalf: one under EB-2 NIW (National Interest Waiver) and the other under EB-1A (Alien of Extraordinary Ability). Our client initially hired us to file an NIW petition but decided to retain our services to file an EB-1A. It is not unusual for petitioners to file more than one petition as it increases the likelihood of obtaining petition approval. Furthermore, an approved EB-1A enables our client to file an I-485 application (final step in the green card process) without waiting for his priority date to become current.

Assembling the Petitions:

Despite being two different petitions, some of the information we included in both NIW and EB-1A petition packets overlapped. Overall, our goal was to convince the USCIS of our client’s impressive credentials, and thus, we made it a point to demonstrate his impressive achievements in both petitions.

1. We highlighted his citation count (80 citations at the time of filing), the 4 peer-reviewed scientific articles he had authored, and the 15 times he had reviewed the work of his peers in the field of applied mathematics.
2. We also presented documents that endorsed and supported our client’s work. Both the I-140 petition packets contained 6 recommendation letters contributed by renowned experts in the field of applied mathematics.

Therefore, it is essential that he be given the opportunity to complete important, cutting-edge research in the United States.”

The statement above was made by a highly-acclaimed professor endorsing our client’s contributions to the scientific community. This letter of recommendation, along with the five others that our client obtained, asserted the value of our client’s continued presence in the US.

3. Both petitions also contained a wealth of information on our client’s research which is focused on the development of mathematical and computational models that enable users to study complex biological processes, such as dynamic cell division. We proved that our client’s work addresses some of United States’ most pressing issues in understanding the molecular mechanisms of disease, including cancer, which in turn allows researchers to develop targeted drug therapies.

The effective manner in which our firm handled our client’s NIW and EB-1A cases led him to retain our I-485 services. We wholeheartedly congratulate our client for securing two petition approvals and we look forward to helping him and his spouse obtain their green cards.
