Case Summary:
Just 45 days after North America Immigration Law Group (NAILG) filed an EB-1A (Alien of Extraordinary Ability) petition on behalf of postdoctoral associate from China, the USCIS approved her case. It would have taken far longer had our client not elected to upgrade her case to Premium Processing (PP) a month after filing. PP is a paid option offered by the USCIS and it allows petitioners to have action taken on their cases within 15 days. True to their word, the USCIS only spent 13 days adjudicating our client’s EB-1A petition before granting their approval.
What did her EB-1A petition packet contain?
Part of our services included obtaining a wealth of information on our client’s various achievements in the field of chemical engineering. We then pieced all the information together to build a strong case for her. Amongst other things, we highlighted the 67 times her work was cited, the 10 published articles to her name, and the 23 times she assessed the work of her peers. Furthermore, we noted her work on data-driven models and analytic techniques for production process monitoring and controlling in particulate and crystallization systems, in addition to investigations of crystal structure-physical property correlation. We then demonstrated to the USCIS that our client’s findings are important to the US as they are applied in process engineering enhancements that allow American manufacturers to access better data analysis regarding the performance of systems in real-time, and to respond to problems or process disturbances more quickly and effectively, leading to a more efficient and cost-effective production process and a higher quality final product.
Another important element of her EB-1A petition packet involved the six recommendation letters contributed by other experts in the field. These letters contained strong statements that supported the approval of our client’s EB-1A petition. As an example, this is what one of our client’s recommenders had to say about her: “… [Client’s] presence in the U.S. is highly important to the field, and that a less qualified scientist could simply not fill the gap left by her absence if she were forced to discontinue her research there.”
