Success Stories: NIW Petition and Green Card Approved for Kentucky-based Ph.D. candidate from South Korea in the Field of Pharmaceutical Sciences

Client’s Testimonial:

“Thank you so very much with all your help. I greatly appreciate it!!”

On September 2nd, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Ph.D. candidate in the Field of Pharmaceutical Sciences (Approval Notice).

General Field: Pharmaceutical Sciences

Position at the Time of Case Filing: Ph.D. candidate

Country of Origin: South Korea

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: Kentucky

Approval Notice Date: September 2nd, 2016

Processing Time: 84 Days

Case Summary:

Just 84 days after North America Immigration Law Group filed an EB-2 NIW (National Interest Waiver) petition on behalf of a Ph.D. candidate from South Korea, Texas Service Center approved her case (it usually takes the USCIS between 4-9 months to process I-140 cases). The case we built for our client was undoubtedly a strong one and here are some of the keys points which we focused on:

  1. We documented our client’s research efforts in the field of pharmaceutical science and demonstrated their significance to the United States. For instance, we proved that her investigations on translational research in the areas of oncology, infectious disease/immunology, and vascular disease contribute to clinicians’ and physicians’ knowledge on the safety and efficacy of medications. Furthermore, we demonstrated that her preclinical and clinical research efforts are contributing to improving public health and reducing healthcare costs in the United States.
  2. Our client’s citation count and publication record were also highlighted. At the time of filing, these numbers stood at 45 and 4 respectively, proving that our client’s work progresses the work of other researchers working in the field.
  3. We also incorporated recommendation letters signed by a handful of her peers, one of whom stated that “[Client] is certainly one of the most accomplished individuals in this area, and the sustained advancement of the field is heavily dependent on her continued research.”

Concurrent Filing:

Applicants applying for their green card in the US have three options if their priority date is current: they can file an I-485 application after their I-140 is approved, file the I-485 while the I-140 is pending approval, or file them simultaneously. Our client opted for the third option and significantly trimmed down the overall wait time in the green card process. From the date of filing to the date of approval, she only waited a little over four months to receive her green card. We congratulate her for becoming an American permanent resident and we thank her for choosing our law firm to help her navigate the complex green card process.
