Case Summary:
Exactly 2 weeks after we filed an EB-1A (Alien of Extraordinary Ability) petition on behalf of a gifted research fellow from India, the USCIS took action on his case by granting their approval. The reason for such rapid adjudication is thanks to Premium Processing (PP), a paid option offered by the USCIS that allows petitioners to have action taken on their cases within 15 calendar days. To make things even sweeter, the USCIS did not issue a Request for Evidence (RFE).
What makes a strong EB-1A case?
Our client’s EB-1A petition dossier was composed of a myriad of details related to his optical sensing research. We noted his many years of experience conducting impactful research and demonstrated that his hard work has paid off manifold. When we filed the case for instance, his work had gathered 134 citations and he had published 10 peer-reviewed scientific articles, 1 book chapter, and 1 magazine article. We also noted his work on the sensing of elements and compounds for various medical and technological applications. Based on what we gathered from his comprehensive research summary, we determined that our client’s findings address some of the United States’ most pressing issues in understanding laser spectroscopy. We also noted his doctoral degree and the whopping 20 reviews and 300 abstracts reviews that he conducted for high impact scientific journals.
Alongside these detailed achievements were six recommendation letters contributed by other experts in the field. These letters served as additional evidence that proved just how useful our client’s findings are to various industries in the United States. According to one of these recommenders: “He has made a substantial impact on the medical field and as he is continuing his work in this focused area of research, it would be most unfortunate to lose his ongoing work.” Another expert stated that “Space travel has historically been of great national interest to the USA and has garnered recent attention with developments […], it is apparent that [Client’s] work is of national significance.” Furthermore, another recommender noted: “[Client’s] work has highly valuable applications in internal combustion engines, which are the basis for much of industry and transportation in the United States.”
Because we were able to build and present a strong EB-1A case for our client, the USCIS was persuaded to approve his petition. We congratulate our client on this milestone and wish him the best as he embarks on the final leg of the green card journey: filing I-485 applications for himself and his spouse.
