On April 11^th, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Fellow in the Field of Condensed Matter and Statistical Physics (Approval Notice).

Case Summary:

A little under 2 months after we filed an EB-2 NIW (National Interest Waiver) petition on behalf of an Iranian postdoctoral fellow, Texas Service Center approved his petition. We are notably pleased at how quickly our client’s petition was adjudicated (on average it takes the USCIS between 4-9 months to take action on a case), and we have no doubt that our skillful presentation of his credentials paved the way for case approval.

When our client first contacted us, he already knew that the best means for him to attain a green card was via the EB-2 NIW visa category. After carefully evaluating his credentials, we agreed. With his Ph.D. in Physics and 4 publications that had gathered 97 citations at the time of filing, our client was suitably qualified for the national interest waiver. The legal team and support staff at North America Immigration Law Group did everything we could to compile and present a strong EB-2 NIW petition to the USCIS. We argued that our client’s work in the field of condensed matter and statistical physics is essential to the United States. Here’s how we went about proving it:

1. Research Reviews: Our client provided us with a comprehensive summary of his research, which we used to carefully review and account for his various projects. We determined that our client’s studies are focused on the topology and the geometry of the ordered assemblies to elucidate the properties of materials in physical world. His results have directly contributed to several industries critical to the U.S. economy such as electronics, optics, biomedicine, silicon digital technologies, space exploration technologies, and materials science. Furthermore, our client’s investigations provide novel solutions to Einstein’s equations, and are contributing to the development of space exploration tools and our understanding of the history of the universe.

2. Recommendation Letters: We needed other experts in the field to confirm with the USCIS that our client’s studies are as important as we made them out to be. Our client managed to convince five of his peers to lend their support, all of whom contributed recommendation letters that briefly discussed his research and its value to the United States. Here is what one of these recommenders had to say in support of our client’s EB-2 NIW petition: “[Client’s] superior effectiveness, original theoretical contributions, and targeted focus on key areas of concern collectively highlight his position among the most creative and advanced scientists working in physics today. In light of this fact, any impediment to [Client’s] continued efforts would have a damaging effect on the advance of physical science research in the U.S. in general, and every effort should be made instead to facilitate his work. It is with great conviction, therefore, that advocate for the continuation of his research efforts.”

Because we were able to demonstrate the significance of our client’s important work to the nation, and that not many other researchers can take his place should his research in the U.S. be halted, the USCIS was persuaded to approve his EB-2 NIW petition. We congratulate our client for obtaining a petition approval, and are pleased that we helping him go all the way—we recently filed I-485 applications for our client and his wife, and we join them as they await good news from the USCIS.
