Approval Notice Date: April 14th, 2016

Case Summary:

Our client was suitably qualified to file his I-140 petition under the EB-2 NIW (National Interest Waiver) visa category. With a doctoral degree and extensive experience researching the development of advanced nanoelectronics and novel materials for applications including high-frequency high-power electronics and energy storage devices, he had all the requirements in the bag. We were tasked with putting together a strong petition packet that highlighted his various accomplishments, both professional and academic, and we did just that. Here are some of the petition’s highlights:

  1. Based on the research summary that our client provided us, we concluded that his work is essential for furthering communication systems, renewable energies, and defense technologies in the United States. We also established that he is an irreplaceable asset and that halting his work in the country would be detrimental to the nation.
  2. We detailed the 25 times our client’s 7 publications had been cited, and demonstrated to the USCIS that he is highly respected by other members of the electrical engineering scientific community.
  3. In a bid to further fortify our client’s EB-2 NIW petition, we asked him to touch base with selected experts working in the field and ask them for recommendation letters. Six experts agreed to lend their support, and one of their letters said, in part, “The United States, like all countries, faces an uncertain future, one that may very well involve energy shortages and military conflict. [Client’s] work is making electronic devices of all types more versatile and reliable and power sources more efficient.” Another letter contained further details on our client’s research along with reasons why his work is important: “In short, [Client] is an amazingly versatile scientist whose work is helping the United States advance technology in ways that are crucial to both the military sector and the consumer market. His record of past achievements, along with his relentless pursuit of excellence, ensures that he will keep producing remarkable results throughout his career.”

North America Immigration Law Group (WeGreened.com) spent several months putting together a strong EB-2 NIW petition packet for our client, and the USCIS only spent one month and 13 days reviewing it before granting their approval. We join our client as he celebrates the happy news, and we wish him well as he embarks on the final leg of the green card journey: filing an I-485 application.
