Client’s Testimonial:
“That is great news. I did not expect to get a decision so early. Thanks again for doing such a thorough and professional job with the application.”
On April 14th, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Senior Technical Professional in the Field of Mechanical Engineering (Approval Notice).
General Field: Mechanical Engineering
Position at the Time of Case Filing: Senior Technical Professional
Country of Origin: India
Service Center: Texas Service Center (TSC)
State of Residence at the Time of Filing: Texas
Approval Notice Date: April 14th, 2016
Processing Time: 1 month, 10 Days
Case Summary:
A little over a month after we filed an EB-2 NIW (National Interest Waiver) petition on behalf of a senior technical professional from India, the USCIS took action on his case by means of an approval notice. It came as no surprise that our client’s petition was approved so quickly; our thorough presentation of his strong credentials made him a suitable candidate for the national interest waiver.
Outstanding Achievements:
There are two steps in the green card process: the I-140 petition and the I-485 application. As we filed our client’s I-140 petition under EB-2 NIW, we had to prove that he is an asset to the United States and that should his work in the country be interrupted, not many other mechanical engineers with similar qualifications can take his place. We supported our claims by detailing our client’s various academic and professional achievements. For instance, we noted his M.S. and a Ph.D. in Mechanical Engineering obtained from a prestigious American university, and demonstrated that his advanced degrees have furnished him with the necessary knowledge to conduct outstanding research in the field of mechanical engineering. We also highlighted the 48 citations gathered from his 6 published papers, and established that other researchers are using his work to progress their investigations.
Strong Support:
Our extensive experience in helping our clients obtain I-140 approvals has taught us that third-party opinions play a very important role in petition approval. This is because the USCIS needs to know that the petitioner’s work is of value not just to his/her employer, but to the entire field as a whole. In this case, we managed to prove that our client’s research is beneficial to not just the scientific community, but to the United States as a whole. We did this by including recommendation letters that our client obtained from six of his peers. Here is a statement extracted from one of these letters: “As scientists continue to improve climate and weather models, which help us understand our atmosphere and prepare for climate change impacts, [Client’s] model and its results will continue to have influence. And while the U.S. as a nation continues to fight the impacts of climate change, it is imperative that researchers who are proven, leading experts in all aspects of atmospheric sciences are continuing their work. Since [Client’s] past work ranks him among these proven, leading experts, I wholeheartedly recommend him and his continued work within the United States.”
One Step Closer:
We join our client as he celebrates the approval of his EB-2 NIW petition. Because he has to wait for his priority date to become current before filing an I-485 application, there is nothing more for him to do until then. When the time comes, we look forward to helping him attain a green card. In the meantime, we wish him well as he continues to develop novel computational techniques and strategies for assisting advancements in climate modeling, hydraulic fracturing, and engineering education.
