On April 5th, 2016, we received another EB-1A (Alien of Extraordinary Ability) approval for a Research Scientist in the Field of Chemical Engineering (Approval Notice).
General Field: Chemical Engineering
Position at the Time of Case Filing: Research Scientist
Country of Origin: China
Service Center: Nebraska Service Center (NSC)
State of Residence at the Time of Filing: New York
Approval Notice Date: April 5th, 2016
Processing Time: 35 Days (Premium Processing Requested)
Case Summary:
With a doctorate in chemical engineering and many years of experience researching the development and characterization of energetic materials, our client has made a name for herself as one of the top researchers in the field of chemical engineering. She contacted North America Immigration Law Group (WeGreened.com) when she decided that she wanted to obtain a green card (we helped her with the first step of the green card process: filing an I-140 petition).
To improve her chances of getting a petition approval, she opted to file two I-140 petitions: one under EB-2 NIW (National Interest Waiver) and six months later, another under EB-1A (Alien of Extraordinary Ability). Thanks to Premium Processing, her EB-1A petition was rapidly adjudicated and she received an approval notice 35 days after it was filed. She is currently waiting for the USCIS to take action on her EB-2 NIW petition.
Building a Strong EB-1A Case:
As EB-1A has a very high standard of law, it comes as no surprise that not everyone qualifies to file their I-140 petition under this visa category. Our client’s strong credentials offered her this privilege, and we worked diligently to detail all the supporting information in her petition packet. Here are some of the things that we included: the 147 citations to her work, her 13 scientific articles and 5 conference proceedings, and the 27 times she assessed the work of her peers for various scientific journals. We also documented her work on the rate and safety of chemical reactions and how to increase the efficiency of various types of technology through the development of novel nanotechnology. Based on what we learned, we convinced the USCIS that our client’s research efforts are extremely beneficial to the United States.
To further strengthen our client’s EB-1A petition, we included recommendation letters volunteered by other expert chemical engineers. We helped our client select these experts, and made sure that they were familiar with her publications and/or had worked with her. The six signed letters that our client managed to obtain were contributed by dependent and independent recommenders, all of whom advocated for the approval of her EB-1A petition. One of our client’s recommenders had this to say about her: “Clearly, the influence of [Client’s] specialized expertise has pervaded the field through her innovative findings and methodological advancements. As such, [Client] has risen to the stature of a world-level authority in chemical engineering, having made a greater influence on continuing research than many of her peers with similar qualifications.”
We congratulate our client on overcoming this significant hurdle in the green card process, and we wish her the best with her continued investigations.
