Case Summary:

At first glance, our client’s Ph.D. in Applied Science and extensive experience in the field of applied bioscience made him seem like a suitable candidate for EB-2 NIW (National Interest Waiver). Even so, we carefully analyzed his credentials to be absolutely certain. As it turns out, we were right, and as soon as an attorney-client relationship arose, we set to work compiling as much information as we could to put together a strong NIW petition dossier for our client.

EB-2 NIW Petition:

One of the first things we did was advise our client, a graduate research associate from Iran, to send us a list of potential recommenders who could contribute recommendation letters. We carefully selected several names and made sure that they were either familiar with our client’s research through his publications and/or had worked with him. We also ensured that these potential recommenders were experts in the field of applied bioscience. Our client did not let us down, and returned with five signed testimonials, all of which supported his EB-2 NIW petition. One of his recommenders wrote, “Few others in the field of applied biosciences have the combination of scientific and technical skills that make [Client] a leader in his field. His future contributions are essential for continued research into genetically engineered crops.” Another expert stated, “[Client’s] skills and abilities have resulted in original research that brings new alternatives to the world of medicine and cancer research. His multi-disciplinary background gives him unique insights into these issues, leading to impressive results that continue to impress his peers.”

Alongside these letters stood data on our client’s 9 publications and the 101 citations to his work. We used this information and other supporting evidence to prove to the USCIS that only a rare class of researchers such as our client can attain such meritorious research results. We also demonstrated that his work on the development and application of novel materials and technology relating to both advanced crop plants and anticancer therapeutics is of great value to the United States, particularly the nation’s health and well-being.

Affirmative Results:

We are pleased that our meticulous presentation of our client’s strong credentials paved the way for case approval. We congratulate our client for obtaining an EB-2 NIW petition approval, and wish him well as he files an I-485 application (last step in the green card process).
