Case Summary
North America Immigration Law Group (WeGreened.com) had the pleasure of working with a postdoctoral fellow from China. Our client needed help filing an I-140 petition under the EB-1A (Alien of Extraordinary Ability) visa category. As soon as he returned the signed contract to us, we took a weight off his shoulders by taking over. From dealing with the USCIS to putting together a strong EB-1A petition packet, we did our best to make this portion of our client’s green card journey as smooth as possible.
Our job was to convince the USCIS that our client deserved to have his EB-1A petition approved. In order to do this, we had to explain how his continued presence in the United States is beneficial to the nation. We started by detailing our client’s research projects in the field of cell biology. By determining that his investigations on the regulation of apoptosis in different types of cells and its effect on tissue injury and repair are essential to the American medical sector, we explained to the USCIS that halting our client’s work in the country would have an adverse effect on public health.
Our legal team also established that our client’s research findings progress the work of other cell biologists. We listed the 17 scientific articles and 8 abstracts that our client published as a result of his research, and the 216 citations gathered at the time of filing. We also noted the weight of his opinions by listing the 21 times he conducted peer reviews for various scientific journals.
To further fortify our EB-1A petition, we incorporated recommendation letters that our client gathered from other influential cell biologists. These letters served as additional evidence to strengthen our argument that our client’s work is important to the United States. Here are some of the things his recommenders had to say:
“It is readily apparent that [Client’s] accomplishments in this field are of the highest standard, and that he is a talented researcher […] As such, the continuation of his research benefits the daily lives of individuals across the world.”
“Given the extensive technical knowledge and expertise that [Client] has garnered over many years of education and training in China and the United States, I feel it is imperative that [Client] be allowed to continue his work in the U.S. He has demonstrated that his sustained participation in his research and his research successes have made important advances in science.”
“[Client’s] groundbreaking work in these fields has assuredly been of great value to the research community, and he is undoubtedly a top-tier scientist working on physiology research. Moreover, I identify [Client’s] research experience as extensive, diverse, and well respected in the scientific sphere. His work has already proven useful for the development of advanced, effective treatment options for a variety of detrimental physiological conditions, which have an impact on medical practice and patient health…”
We would like to congratulate our client on his EB-1A approval, and we wish him well as partakes in the final step of the green card process: the I-485 application.
