“The online myUSCIS Case Status shows my NIW-140 was approved. Thank you very much for your outstanding work!”
On March 11th, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Software Engineer in the Field of Computer Science (Approval Notice).
General Field: Computer Science
Position at the Time of Case Filing: Software Engineer
Country of Origin: China
Service Center: Texas Service Center (TSC)
State of Residence at the Time of Filing: Massachusetts
Approval Notice Date: March 11th, 2016
Processing Time: 3 months, 3 days
Case Summary:
Not long ago, we received a notification from Texas Service Center informing us that our client’s EB-2 NIW (National Interest Waiver) petition had been approved. Our client, a software engineer from China, now has to wait for her priority date to become current before filing her I-485 application (last step towards a green card).
What Does ‘Priority Date’ Mean?
The USCIS has specific quotas in place when approving green cards to applicants born in certain countries. In this case, our client was born in China and holds an EB-2 approval. This restricts her from filing an I-485 application until her priority date becomes current, which is several years from now. For the latest update on priority dates, please refer to our visa bulletin: http://www.wegreened.com/visabulletin/
North America Immigration Law Group (WeGreened.com) was tasked with helping our client put together a strong EB-2 NIW petition that painted her in a flattering light. We worked diligently to make it happen and by the time we were ready to file the case, we had amassed a ton of information on our client’s copious accomplishments. Here are several noteworthy achievements we focused on:
- We discussed our client’s publication record that had gathered 140 citations, and highlighted the value of her work to other researchers.
- We detailed our client’s research efforts on machine learning and data mining in the field of computer science. Her design and implementation of state-of-the-art analytic techniques, as well as development of highly-distributed algorithms were extremely well-received. We demonstrated that our client’s research efforts benefit not just her employer and her field, but the United States as a whole, especially its medical, public health, manufacturing, and retail sectors, as well as any industry which uses big data.
- By detailing our client’s two master’s degrees, we validated that she possesses the knowledge and skillsets to conduct relevant research in her field.
- Our petition also included recommendation letters contributed by other prominent computer scientists. The reason we placed emphasis on third-party opinions was to convince the USCIS that our client’s work is truly relevant to not only her employer, but to many other American and foreign researchers who are continuously progressing the field.
We congratulate our client for getting one step closer to her green card. When her priority date becomes current, we look forward to helping her file an I-485 application. In the meantime, we wish her the best with her investigations.
