Case Summary:
North America Immigration Law Group (WeGreened.com) helped a talented postdoctoral research associate from India file two I-140 petitions: one under the EB-2 NIW (National Interest Waiver) visa category, and the other under EB-1A (Alien of Extraordinary Ability). It is not unusual for our clients to file two petitions at the same time as it increases their chances of getting an approval. In this case, our client’s EB-1A petition was approved whereas his EB-2 NIW petition is still pending approval. We are pleased that our client obtained an EB-1A approval because now, he does not have to wait for his priority date to become current before partaking in the second and final step of the green card process: the I-485 application.
‘Current’ Priority Date:
The USCIS has a strict quota system in place that restricts the number of green cards granted to applicants with EB-2 NIW approvals who were born in certain countries (India is one of them). As our client was born in India, he would have to wait several years for his priority date to become current if he chooses to apply for a green card based on an approved NIW petition. However, seeing that there is no quota in place for the EB-1 visa category, our client may file an I-485 any time he wants with his EB1A approval.
Our Winning EB-1A Petition:
Our job was to compile as much information as we could on our client’s professional accomplishments and put together a strong EB-1A petition packet. Our presentation was composed of our client’s eight publications, the 91 citations to his work, and the 21 times he conducted peer reviews for a number of acclaimed scientific journals. We also detailed his research projects related to heart failure, as well as investigations linked to other aspects of the human body. Based on everything we gathered, our petition packet demonstrated to the USCIS that our client’s work is important to the United States. To bolster our presentation, we incorporated recommendation letters signed by other expert molecular biologists, one of whom firmly stated, “There are few scientists capable of equaling both the sheer volume, and caliber, of [Client’s] career. I am confident in stating that he could not be replaced, and that the field of biochemical research would suffer without his presence.”
